Dnevni avaz: The amendment of a delegate in the Parliament of BiH, Mirjana Malić, which has been adopted on the proposed Law on prohibition of discrimination, will stop the company owners from behaving towards their employees as they are in their ownership.

If some of the owners or chiefs in private companies try to behave this way, workers will have a possibility to complain to the ombudsmen, but also file a suit against their employers at the authorized courts. If the competent authorities determine that the Law on prohibition of discrimination has been violated, worker will get a cause.

Delusion in public

Malić says that there has been a delusion in public that this law enables concluding the same-sex marriages and offers the possibility for those to adopt the children, and that the instructions of the Inter-Religion Council in this case were wrong.

– Everywhere in the world this issue is being solved by a special or a family law. Because of that, in our law on prohibition of discrimination we have stated that these issues are being regulated by the family law – Malić has explained.

– This law forbids the possibility of discrimination by the basis of gender, race, religion, age or anything else. Besides that, amendment on this law prohibits mobbing, sexual abuse of the employed in public and private sector – has been explained by Malić.

Penalties have been prescribed for violators. Individual, who does a private business, is being prescribed the amount from 1.000 to 5.000 KM, legal person under whose supervision the Law has been violated – from 2.000 to 10.000 KM, public corporation, chamber, public company, agency and other legal subject, as well as the institution with public competencies – from 2.000 to 10.000 KM, administrative organization or public company – from 2.000 to 8.000 KM. The person, responsible in the state institution or authority, entity, canton, municipality and institution of the Brčko District BiH, will be penalized by the amount from 1.000 to 5.000 KM.
