Nezavisne novine: The Civil Property Commission cannot agree on the Draft Law on civil property due to the opposite standpoints on its registration and because of that the chairman of this commission expects that it will get dismissed by the Council of Ministers of BiH.

"I have offered a compromising Proposal draft law on civil property, which has not been accepted. I do not see a way out of this situation, except for the Council of Ministers of BiH to dismiss us all and nominate a new commission, whose members would be persons ready to cooperate. The Council of Ministers of BiH has already dismissed one commission, nominated us into the new one, but since we are not able to reach the agreement, then the only logical thing to do is to dismiss us as commission", has been said by Zvonimir Kutleša, chairman of the Civil Property Commission, after the yesterday's session.  

Compromising proposal has implied that the whole property received by the succession of former Yugoslavia and whose owner was former SR BiH becomes registered as the ownership of the state BiH.

By the same proposal, a part of property would be registered as the ownership of lower levels of government, while BiH would be erased from the ownership registries for that part of property.

Five years and two commissions

At the end of 2004., The Council of Ministers of BiH has formed the Civil Property Commission. Its two integral parts have not succeeded to prepare a law on division of civil property. The High Representative of the International Community for BiH has several years ago forbidden disposing by the civil property until the adoption of the law on its division.

"Members of Commission from the RS have thought that this proposal is opposed to other provisions of proposed draft law which stipulate that the lower levels of government are the owners of property which is not needed to the state institutions. There were also other standpoints totally opposite to the positions of representatives of the RS. With the lack of willingness for compromise, we could have only concluded that we are not able to propose a draft law on civil property", Kutleša has said.

The leaders of SDA, SNSD and HDZ BiH, Sulejman Tihić, Milorad Dodik and Dragan Čović have agreed that the civil property becomes divided by functionally-territorial principles. BiH would get the property needed for functioning of state institutions, and the rest would be divided by entities, cantons, towns and municipalities. Leaders of parties agree that the division of property gets regulated by law by which the whole property would be registered firstly on state, and then divided by this principle. Integral part of law would also be the agreement on property division.

"We will introduce the Council of Ministers of BiH to a non-success in preparation of law. I will personally not submit the resignation, because I have been doing this earlier, so I have not received a support. I believe that the Council of Ministers of BiH will undertake required measures, because we are not going to make a new law. I have been asking for support of the parties and the OHR for my proposal, but I have not received it", Kutleša has said.

The adoption of law on civil property is one of the five conditions for transformation of the OHR into the Office of the Special Representative of the EU for BiH.

Šefik Džaferović, deputy chairman of SDA, says that three leaders have agreed on the principles for division of civil property in Sarajevo.

"Agreed principles have been transformed into the law written by the state solicitor. The Commission needs to gather around this proposal and there is no need for some new solutions", Džaferović has said

Mišo Relota, spokesperson of HDZ BiH, says that the politics has said what it had to say in case of the civil property, and that the professional part of job needs to be done now.

"After the session of Commission, which has not succeeded to offer a solution, the Council of Ministers of BiH needs to do its move now, and it needs to find a way out from this situation", Relota has said.

Rajko Vasić, executive secretary of SNSD, says that "it is bad that there are people who tend to destroy all the agreements".

"Chairmen of SDA, SNSD and HDZ BiH have contributed a lot into this agreement, which is now being destroyed. Who will be ready for new compromises and agreements after this? This is very bad for BiH. Possible solution could be that the Council of Ministers of BiH on the basis of the agreement from Prud, without the Civil Property Commission, prepares the law", Vasić has said.
