Nezavisne novine: The Law on Civil Service protects the employed in municipal administrations in a way that they do not have to be responsible for their unkindness and irresponsibility towards the citizens, whom they should serve.
This has been claimed by Ibrahim Hadžibajrić, mayor of the municipality Stari grad, one of the rare ones, who has emphasized this problem in work of municipal administrations.
The fact that one of the biggest problems is in the unkindness of servants, has been claimed by the Centers of Civil Initiatives (CCI), which in 14 BiH municipalities follow the work in local communities.
Siniša Bencun, representative of CCI in Bijeljina, says that the citizens themselves have identified the basic problems, and one of them is the work of servants at desks and concrete assistance for citizens as well.
"There were also complaints about hiring servants in municipal administrations and inaccuracy at contests", Bencun has pointed out by adding that there will be some detailed analyses and data on work of administration in local communities in the next month.
Hadžibajrić claims that the receipts are always being handed to the head person of some institution even though the servants are the ones, who directly communicate with citizens.
"All the problems can be solved by nice behavior and a smile. It does not cost anything, but it will mean a lot to citizens. Once the servants are kind, everything goes easier later", Hadžibajrić has said. He also admits that there are complaints about work of servants in his municipality and that there were cases of initiating the discipline procedures.
"There is a legal possibility of initiating the discipline procedure on the basis of complaints of citizens, and then you have a first-rang and second-rang authority, decisions and complaints and it all takes a half of the year, while nothing really happens at the end. Everybody counts on the fact that someone will lose their nerves. The only possibility is to undertake something from the top and it is the change of systematization, for which we have needed eight months", Hadžibajrić has said, by adding that the behavior of servants would change depending on getting stimulated or de-stimulated by their salaries.
Enver Išerić, director of the Civil Service Agency (ADS) of the FBiH, has earlier warned that they cannot sanction anyone even though they have noticed some imperfections by hiring the interns in municipalities.
In the ADS FBiH they have been receiving some anonymous notifications from the municipalities, where they have been delivered some resolutions on illegal acceptance of civil servants on undetermined duration and on illegal promotions of civil servants. The ADS FBiH regularly does the audit in civil service and because of the violations of law they have been adopting some resolutions on ending the work relation.
According to data from the website of this agency, in 2008 they have issued 432 dictates for adopting the resolution on ending the work relation for 117 civil servants because they have not fulfilled the condition in a sense of professional qualification, and for 290 servants, because they have not based their work relation in accordance with law, while 25 civil servants have not fulfilled any of these two conditions.
