Oslobođenje: The Joint Human Rights Commission of the Parliament of BiH has yesterday refused the arrangement between BiH and submitters of appellation, Dervo Sejdić and Jakob Finci, which has been proposed by the European Court for Human Rights from Strasbourg. Sejdić and Finci have submitted to this court an appellation because of discriminatory regulations of the Court of BiH and the Election Law of BiH, which are not in accordance to the European Convention on Human Rights, (which is a supplemental part of the Constitution of BiH), and which limit the rights of all BiH citizens on the system of nominating for election positions.
The European Court for Human Rights has offered an arrangement, by which BiH would be exempted from the verdict adoption, and obligated by its regulations to solve the issue and harmonize the constitutional solutions, which has not been accepted. The Deputy Chairman of the Joint Human Rights Commission of the Parliament of BiH, Ivo Miro Jović has pointed out for Oslobođenje (after the session in Sarajevo) how on his and the proposal of member Niko Lozančić there has been adopted such conclusion, in order to leave some room for the European Court for Human Rights to "confirm the real condition".
– The Constitution of BiH has been given to us by the International Community. Now, the European Court for Human Rights, as well as the International Community, should confirm that the solutions from that constitution are discriminatory. The verdict, by which violation of human rights is being confirmed, will give an additional stimulation to the initiative for the quickest possible change of the Constitution of BiH. This would make the institutions and political factors in BiH more serious, by forcing them to arrange the legislation of country in harmonization with the solutions prescribed by the European Convention on Human Rights – Jović has said.
– He has pointed out that, besides the cases of Sejdić and Finci, reaction from Strasbourg should soon be known as well in the case of Ilijas Pilav, who has also sued BiH, because he was not able to register his candidacy for Bosniak member of the Presidency of BiH from the Republic of Srpska.
