Meeting of the Working group for the Administrative Procedure area

Consideration of the activity priorities
Those were some of the main topics on the first meeting of the Workibg Group for the area of Administrative Procedure, held on the November, 24th at the Public Administration Reform Coordinator’s Office in Sarajevo.
The meeting was held with the presence of the Working Goup members: Mr. Zvonimir Kutleša (General Secretariat of CoM BiH), Mrs. Fazila Musić (Ministry of Justice BiH), Mr. Milenko Lepušina (Aministration of the Civil Protection of the FBiH) i Mrs, Milanka Šopin (Ministry of Administration and Local Self-governance of RS), and Mr. Suad Musić, Mrs. Dragica Lakić, Miss Jadranka Čečar and Mr. Aleksandar Karisik as the representatives of the PARCO. Mr. Folkert Milch and Mr. Samir Mušović from the EC Technical Assistance Project Team for support to the PARCO, and Mrs. Bianca Schönberger from OHR, were also present
At the very beginning of the meeting, the participants were introduced with the fact that the PAR strategy and the Action Plan have been adopted by the all governments in the BiH, and that now the phase of the implementation is following. After that, the scheme of the implementation structure, which will be sent on the adoption to all of the governments, was presented with respect that, after the adoption comes the operational phase.
Proposal for the way of grouping of the activities was also presented to the participants, with the remark that there are two big groups of activities in this area: for the administrative procedure and for the administrative inspection. In accordance to this, activities of the Working Group will be developed in these two directions. Methodology of work and plan of the future activities was also discussed.
Also, the possibility of hiring of the domestic and foreign experts as asupport to the WG, and forming of the sub groups within this WG, for the increasing of the efficiency in the work, was also one of this meeting's topics. Within the scope of mentioned sub groups, one sub group for the area of administrative decision and one for the administrative inspection and the discipline responsibility would be established. It was pointed out that there are some measures that can be performed automatically, and those where the technical assistance which will be enabled through PAR Fund, is necessary. Idea proposal for the implementation of the foreseen measures should originate from the WG. After that, PARCO will create project fiche and deliver it to the WG on the contemplation. Agreed proposal will be send to the Managing Board of the PAR Fund for the approval and final financing.
It was also emphasized that the using of the PAR Fund is a certain innovation, because the donors decided, for the first time, to lay money to one place and disbursement of that funds committed to the domestic institution. In order to test its capacities, PARCO has offered to the donors 4 pilot projects as a support to the implementation of the Action Plan 1 activities. One of those projects refers to the area of the administrative procedure and it will be financed from the PAR Fund after the completed procedure.
The accent was also put on the fact that the role of the institution's representatives will be drastically changed comparing to the phase of the Strategy's preparation, and that now we have the opportunity to prepare idea propositions and to design what we think that is our real needs, all by ourselves. This is where the support of the WG members is particularly expected.
After the discussion that comprised all mentioned topics, WG members expressed theirs satisfaction with the fact that the PAR Strategy implementation is starting and that the International community pointed out its confidence. They also stated that the phase of implementation will be much more complicated than the phase of the Strategy preparation. The importance of the entity coordinators was stressed out as well as theirs status in the communication with theirs governments.
The WG, concernig to law changes, should be expanded with the representatives from the Ministry of Justice from all levels, as well as with the representatives from the levels of the municipalities. In some following phase, people from te Universities will be joined.
After this meeting, the WG will hold regular meetings and it will be expanded with the necessary experts for this area in order to function more efficiently. PARCO will coordinate all activities over the coordinator for this area and it will contact with the donors in the area of financing of the projects for the implementation of the Action Plan from the PAR Fund. Along with that, PARCO will conduct all the necessary activities in order to ensure successful implementation of the PAR in this area.
