Brief Description:

 General objective

The ultimate objective of the project is support to the process of democratic stabilisation and public administration reform through improvement of the quality of the existing and future legislation using better regulation mechanisms that decrease administrative barriers.

Thus defined, the objective is simultaneously compatible with the key objectives from the Action Plan 1 of the public administration reform for the area of Administrative Procedures and Administrative Services and Strategic Planning, Coordination and Policy Making:

AP 1.2. Establish the system of reduction of administrative obstacles (RAO) in the proposals of regulations through mechanisms of regulatory impact assessment (RIA).

 

AP 1.3. Establish a system of reduction of administrative obstacles in the existing regulations.

 

AP 5.1. Establish and/or strengthen the capacities of the institution/s accountable for control of regulations regarding the administrative obstacles, gathering proposals for the RAO, for preparation of the action plan of RAO and control of harmonisation with the system of administrative procedure and public administration in general.

 

SPCPM 2.1. Establishment of the necessary mechanisms in the Rules of Procedure (of the CoM / the Governments) for achievement of the quality standards of regulations / policies, which include: horizontal and vertical coherence (compliance with all institutions), consultations with the interested public, impact assessment, elimination of administrative barriers, legal compliance and nomo-technical correctness.

 

Purpose of the Project

The purpose of the project is building the capacity of the employees of the civil service at the level of the institutions of BiH, the RS, the FBiH and the BD BiH by enhancing their ability to prepare legislation that will prevent creation of unnecessary burden for the business community and the society as a whole, and review of certain part of the existing legislation and in it identification and elimination of such burdens.

 

Brief Description

The project is common for all four administration levels in BiH. Organisation structures for better regulation are being developed at all four levels, and are at various levels of development, so the project activities are defined in the manner to reflect the real needs of every administration level (establishment or upgrade of the existing system of better regulation). At the levels of BiH and the BD BiH, a support will be provided in establishment of strategic, legal and institutional framework, having in mind that they were established at the entity levels (the FBiH and the RS) either by the government measures or by the activities of other donors, primarily the IFC.

An important part of the project is aimed at establishing and strengthening human capacities for work in jobs of better regulation, through trainings and engagement of external staff.

Additionally, the support will be provided in implementation of the pilot projects for regulatory impact assessment (ex post) at all four administration levels, as well as support in improvement and development of information technologies linked with reduction of administrative barriers at the level of the FBiH and the RS.

– Total contracted budget, without VAT, is in the amount of BAM 1,078,400.00; The project consists of four components.

  1. The first component is related with establishment of the overall project structure and defining the framework for establishment of the system of reduction of administrative barriers and regulatory impact assessment for the level of the institutions of BiH and the BD BiH.
  2. Building and/or strengthening of human resources in the institutions (including line ministries and other relevant administration bodies) for implementation of the affairs of reduction of administrative barriers and regulatory impact assessment (including public consultations) at all administrative levels in BiH.
  3. Implementation of the pilot project for regulatory impact assessment and reduction of administrative barriers, with participation and consultation exercises of the civil society at the level of the institutions of BiH, the FBiH, the RS and the BD BiH.
  4. Development of capacities of information technologies linked with reduction of administrative barriers at the level of the FBiH and the RS.
