The House of Representatives of the Parliament of BiH has today adopted the Proposal amendment 1 to the Constitution of BiH on status of the Brčko District. The amendment has been adopted by 36 votes "for", one "against" and two reserved.

The Party for BiH and the independent candidate, Momčilo Novaković have withdrawn the interposed amendments to the Proposal amendment on status of the Brčko District, while the amendments of Mirko Okolić from the Serbian Democratic Party and Hadži-Jovan Mitrović from the National Democratic Party, have been rejected.

Goal of the amendment 1 to the Constitution of BiH on status of the Brčko District is to ensure to the Constitutional court of BiH a competency to make decisions in any kind of dispute related to protection of the finally determined status and authorizations of the Brčko District of BiH, which can appear between one or more entities and the Brčko District, or between BiH and the Brčko District by this Constitution and decisions of the Arbitrary tribunal, and to ensure that the Assembly of the Brčko District has an access to the Constitutional court of BiH regarding this issue.

By the Proposal amendment to the Constitution of BiH, the Brčko District is being arranged as the unit of the local self governance under the sovereignty of BiH.

Territory of the Brčko District has been defined as a territory in the joint ownership of entities, and the Constitutional court of BiH is being given the competency to make decisions in any kind of disputes related to protection of determined status and authorizations of the Brčko District and BiH which can appear between the entities or BiH and the Brčko District.

Such disputes, as it has been stipulated by the amendment, it is possible to initiate with the approval of majority of delegates of the Assembly of the Brčko District, which includes at least 1/5 of the elected delegates from each constitutional nation.

The Proposal amendment 1 to the Constitution of BiH will tomorrow be deliberated by the House of Peoples of the Parliamentary Assembly of BiH as well.

The House of Representatives and the House of Peoples of the Parliamentary Assembly of BiH have on 4th and 5th March, 2009. supported the Proposal amendment to the Constitution of BiH in its first reading, after which there has been organized a public discussion, has been informed by the agency SRNA.
