Dnevni avaz: By appointment of seven directors and deputy directors of penal institutions in the FBiH, the Federal Government broke the Law on the Civil Service Agency. Instead of public vacancy, expert evaluation of candidates and other evaluation procedures, for the directors were appointed persons proposed by the minister of justice of the FBiH, Feliks Vidović.

Article 74 of the Law clearly states that it is within the CSA’s competency also the appointment of the managers of prisons and bodies for violations. The Government invoked the Law on Criminal Sanctions, where it is stated that the Government appoints the directors, but that regulation should be harmonized with the one treating the Civil Service Agency of the FBiH – said for our newspapers the Agency director, Enver Išerić.

He points out that the Government appointed the directors although he warned them, and that this move can be an introduction in new violations of regulations and tearing down the system of appointment.

By the Government’s logic, tomorrow can be replacements and appointments of assistant ministers, secretaries and all administration directors, which is absolutely incorrect. It is also incorrect that persons cannot be replaced from their positions. Problem is that competent authorities do not want to apply the regulations, and as an example how somebody can loose not only a function, but also the work booklet, is that somebody receives two negative evaluations for work – Išerić pointed out.

Išerić did not want to prejudice what will happen with the newly appointed directors, but from the practice so far, it is known that on every violation of the law of independence of election of civil servants and managers, the Office of High Representative reacted.

As a director of the correctional facility in Bihać, Zikrija Karabegović was appointed, in Sarajevo, Alija Berberkić, in Mostar, Romeo Zelenika, in Tuzla, Hasan Hodžić, in Zenica, Nihad Spahić, in Orašje,  Ivo Ivkić and in Busovača, Marko Krišto.
